These Terms govern your use of eliray.co (the "Site") and any purchase you make from us. In these Terms, "Eliray", "we", "us", and "our" mean Eliray, and "you" means you, whether you are browsing, registered, or buying.

By using the Site or placing an order, you agree to these Terms. If you don't agree with them, please don't use the Site.

Our store runs on Shopify Inc., which provides the ecommerce platform that lets us sell to you.

1. Eligibility

You must be at least the age of majority where you live — 19 in British Columbia — to place an order. If you are under that age, you may use the Site only with the involvement of a parent or guardian who accepts these Terms on your behalf and is responsible for the order.

You may not use the Site for any unlawful purpose, or in a way that breaks the law where you are.

2. Changes to these Terms

We may update these Terms from time to time. The current version always lives on this page with the date it took effect. Changes apply to orders placed after they're posted; they don't retroactively change the terms of an order you've already made.

If you keep using the Site after a change, you accept the updated Terms.

3. Your account

If you create an account, you're responsible for keeping your login details secure and for anything done through your account. Please give us accurate information and keep it current — particularly your email and shipping address, since we use them to fulfil and communicate about your order.

Tell us promptly if you think someone else has accessed your account.

4. Products and customization

Most Eliray pieces are made to order. You select a base and choose the stones, length, and other options, and we assemble the piece to your specification.

What you see and what you get. We photograph our pieces under neutral lighting and publish measurements in millimetres on every product page. Even so, screens differ — colour, contrast, and brightness vary between monitors and phones, and the way a stone reads on your device may not be exactly how it reads in your hand. Please review measurements and descriptions carefully before ordering, and email us if you're unsure.

Natural variation. Our pieces are assembled by hand, and many use natural or semi-precious stones. Small differences in colour tone, inclusion pattern, stone size, and setting between one piece and the next are inherent to the materials and the process. They are part of the character of a handmade piece and are not defects.

Materials. Material composition — including plating type and thickness where applicable — is stated on each product page. Where a piece is plated rather than solid metal, we say so. Weights and dimensions are approximate and subject to normal manufacturing tolerance.

Availability. We may limit quantities, restrict sales to particular regions, or discontinue a piece or a stone option at any time. If a stone or component becomes unavailable after you order, we'll contact you to arrange a substitute, a credit, or a refund — your choice.

5. Content you submit through the customizer

If you supply engraving text, a reference photograph, a name, a date, or any other content for a customized piece, you confirm that:

You own it or have permission to use it
It doesn't infringe anyone's copyright, trademark, or other rights
It isn't unlawful, hateful, threatening, obscene, or designed to impersonate someone

You keep ownership of what you submit. You give us permission to use it for the limited purpose of producing and delivering your order.

We may decline to produce a piece. We reserve the right to refuse any customization request — including engraving text or reference imagery — that we consider unlawful, offensive, infringing, or that we're simply not comfortable making. If we decline after you've paid, we'll refund you in full.

Please check your spelling. Engraving and personalization are reproduced exactly as you enter them, and a piece produced to a typo you submitted is not a manufacturing defect.

6. Orders, pricing, and payment

Prices are in Canadian dollars and may change at any time before you order. The price that applies is the one shown at checkout when you place your order.

Taxes are calculated at checkout based on your shipping address. Orders shipped outside Canada may attract import duties and customs charges in the destination country, which are your responsibility and not included in our prices.

When the contract is made. Your order is an offer to buy. Our automatic order confirmation email acknowledges we've received it — it isn't acceptance. A contract forms when we email you to say your order has been dispatched, or, for made-to-order pieces, when we confirm we've begun production. Until then we may decline the order.

We may refuse or limit an order. We can decline or cancel orders at our discretion, including where we suspect fraud, where an order appears to be from a reseller, or where we can't verify billing details. If we cancel a paid order, we refund it in full.

7. Errors and pricing mistakes

Product descriptions, images, prices, promotions, shipping charges, and availability on the Site may occasionally contain errors.

We may correct errors and cancel affected orders at any time, including after you've ordered and paid — for instance, if a piece was listed at an obviously incorrect price. If we cancel on this basis, we notify you and refund you in full promptly. That refund is your sole remedy in these circumstances.

We're not obliged to keep information on the Site updated except where the law requires it.

8. Production and delivery

Made-to-order pieces take time to assemble. Estimated production times are shown on the product page and in your order confirmation. These are estimates, not guarantees.

Delivery times quoted by us or by carriers are also estimates. Once a parcel is handed to the carrier, transit time is outside our control. We'll help you trace a delayed or missing parcel — see our Refund, Returns & Warranty Policy for how that works.

Risk in the goods passes to you on delivery.

9. Returns, exchanges, and warranty

Returns, exchanges, defect claims, and warranty are governed by our Refund, Returns & Warranty Policy, which forms part of these Terms.

In short: customized pieces are final sale except where faulty; ready-to-ship pieces may be returned within 14 days for store credit or exchange. Please read the full policy before ordering.

10. Our intellectual property

Everything on the Site — our product photography, renderings, designs, written descriptions, logo, brand name, page copy, and the look and feel of the Site — belongs to Eliray or is used under licence, and is protected by copyright, trademark, and other laws.

You may not copy, reproduce, republish, modify, scrape, or use any of it commercially without our written permission. Buying a piece of jewellery doesn't transfer any rights in our designs or imagery to you.

If you believe something on the Site infringes your rights, email hello@eliray.co and we'll look into it.

11. Reviews, comments, and submissions

If you post a review, send us photographs, or submit ideas or suggestions, you grant us a non-exclusive, royalty-free licence to use, edit, reproduce, and publish that content in connection with our business, including in marketing, without payment to you.

You're responsible for what you submit. Don't post anything false, defamatory, obscene, infringing, or impersonating someone else.

We may — but aren't obliged to — monitor, edit, or remove content at our discretion. We're not responsible for content submitted by users.

We don't undertake to keep unsolicited ideas or suggestions confidential.

12. Prohibited uses

You may not use the Site:

For any unlawful purpose, or to encourage unlawful acts
To infringe our intellectual property or anyone else's
To harass, abuse, threaten, defame, or discriminate against anyone
To submit false or misleading information
To upload viruses or malicious code
To scrape, spider, crawl, or harvest data or personal information
To interfere with or circumvent the Site's security features
To place orders for resale or distribution without our written agreement

We may suspend or terminate your access for any of these.

13. Third-party tools and links

The Site may use third-party tools and link to third-party websites. We don't control them and provide access to them as-is, without warranty. Your use of a third-party tool or site is at your own risk and subject to that provider's own terms, which you should read.

We're not responsible for third-party content, products, or services, or for any dealings you have with a third party.

14. Privacy

Personal information you give us is handled in accordance with our Privacy Policy, which forms part of these Terms.

15. Disclaimers and limitation of liability

Please read this section carefully. Section 16 sets out important limits on it.

We don't warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. The Site and its content are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Eliray and its owners, employees, contractors, suppliers, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or replacement costs — arising from your use of the Site or of any product bought through it, whether the claim is framed in contract, negligence, or otherwise, and even if we've been told such damages were possible.

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid for the order the claim relates to.

16. Your rights as a consumer

Nothing in these Terms excludes, restricts, or modifies any right, warranty, condition, or remedy you have under consumer protection law that cannot lawfully be excluded.

That includes rights under British Columbia's Business Practices and Consumer Protection Act and Sale of Goods Act, and equivalent legislation in other provinces — for example, the implied conditions that goods correspond with their description, are of merchantable quality, and are reasonably fit for their purpose. Under BC law, any attempted waiver of those rights is void.

If any part of Section 15 conflicts with a right the law gives you as a consumer, the law prevails and Section 15 applies only to the extent it lawfully can.

17. Indemnity

You agree to indemnify Eliray and its owners, employees, and contractors against any third-party claim, including reasonable legal costs, arising from your breach of these Terms, your violation of any law, or your infringement of anyone's rights — including through content you submit through the customizer.

18. Termination

These Terms apply for as long as you use the Site. You can end them by stopping.

We may terminate your access without notice if we believe you've breached these Terms. Obligations that arose before termination — including payment for orders already placed — survive it.

19. General

Severability. If any provision is found unenforceable, it's severed and the rest stays in force.

No waiver. If we don't enforce a provision, we haven't given up the right to enforce it later.

Entire agreement. These Terms, together with our Privacy Policy and Refund, Returns & Warranty Policy, are the whole agreement between us about your use of the Site, and replace any earlier understanding.

Assignment. You may not transfer your rights under these Terms. We may assign ours in connection with a sale or reorganization of the business.

Headings are for convenience and don't affect interpretation.

20. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have jurisdiction, except that nothing here prevents a consumer from bringing a claim in the courts of their own province where the law gives them that right.
